For the payment of a claim allowed by the General Accounting Office pursuant to the Act entitled "An Act for the relief of officers and soldiers of the volunteer service of the United States mustered into service for the War with Spain, and who were held in service in the Philippine Islands after the ratification of the treaty of peace, April 11, 1899", approved May 2, 1940 (Public Act Numbered 505, Seventy-sixth Congress), and which has been certified to the Seventy-ninth Congress under section 2 of the Act of July 7, 1884 (5 U. S . C . 266), under the War Department in Senate Document Numbered 225 and House Document Numbered 583, $652.11. TITLE IV-GENERAL PROVISIONS SEC. 401. No part of any appropriation contained in this Act shall be used to pay the salary or wages of any person who engages in a strike against the Government of the United States or who is a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advocates, or is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Provided, That for the purposes hereof an affidavit shall be considered prima facie evidence that the person making the affi- davit has not contrary to the provisions of this section engaged in a strike against the Government of the United States, is not a mem- ber of an organization of Government employees that asserts the right to strike against the Government of the United States, or that such person does not advocate, and is not a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Providedfurther, That any person who engages in a strike against the Government of the United States or who is a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advocates, or who is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence and accepts employment the salary or wages for which are paid from any appropriation contained in this Act shall be guilty of a felony and, upon conviction, shall be fined not more than $1,000 or imprisoned for not more than one year, or both: Providedfurther, That the above penalty clause shall be in addition to, and not in sub- stitution for, any other provisions of existing law: Providedfurther, That the provisions of this section shall apply to all appropriations or funds available for obligation during the fiscal year 1947, however made available, if not heretofore made applicable (any exclusions made in any other Act excepted) to such appropriations or funds in the respects herein provided. SEC. 402. Nothing contained in this or any other Act shall be con- strued to alter, or modify in any manner whatsoever, the aggregate maximum personnel ceilings established by section 14 (a) of the Federal Employees Pay Act of 1946 (Public Law Numbered 390), nor to authorize the compensation of a greater aggregate number than the number provided for in the aforesaid Act.
