53 STAT.] 76TH CONG. , 1 ST SESS. -CH. 281 -JULY 15, 1939 the construction of such bridge, and the Commissioners are authorized to enter into contract or contracts for the completion of such bridge at a cost not to exceed $550,000; For the construction of a second story to the highway garage, at Second and Bryant Streets Northwest, to provide additional storage space for motor vehicles and other equipment, including the prepa- ration of plans, inspection, construction, and incidental expenses, $50,000; To carry out the provisions of existing law which authorize the Commissioners of the District of Columbia to open, extend, straighten, or widen any street, avenue, road, or highway, in accord- ance with the plan of the permanent system of highways for the District of Columbia, including the procurement of chains of title, $150,000, to remain available until June 30, 1941: Provided,That this appropriation shall be available to carry out the provision of exist- ing law for the opening, extension, widening, or straightening of alleys and minor streets and for the establishment of building lines in the District of Columbia; For assessment and permit work, paving of roadways under the permit system, and construction and repair of sidewalks and curbs around public reservations and municipal and United States build- ings, including purchase or condemnation of streets, roads, and alleys, and of areas less than two hundred and fifty square feet at the intersection of streets, avenues, or roads in the District of Colum- bia, to be selected by the Commissioners, and including maintenance of non-passenger-carrying motor vehicles, $150,000; In all, $3,890,500, to be immediately available, to be disbursed and accounted for as "Street improvements", and for that purpose shall constitute one fund: Provided, That assessments in accordance with existing law shall be made for paving and repaving roadways, alleys, and sidewalks where such roadways, alleys, and sidewalks are paved or repaved with funds herein appropriated: Provided further, That any portion of this appropriation may be used for payment to con- tractors and for other expenses in connection with the expense of design, construction, and inspection of grade-crossing elimination and other construction projects authorized under section 8 of the Act approved June 16, 1936 (49 Stat. 1521), and section 1-b of the Fed- eral Aid Highway Act of 1938 (Public, Numbered 584, Seventy-fifth Congress), pending reimbursement to the District of Columbia by the Department of Agriculture, reimbursement to be credited to fund from which payment was made. The Commissioners of the District of Columbia are authorized and empowered, in their discretion, to fix or alter the respective widths of sidewalks and roadways (including tree spaces and parking) of all highways that may be improved under appropriations contained in this Act. No part of any appropriation contained in this Act shall be avail- able for repairing, resurfacing, or paving any street, avenue, or road- way by private contract unless the specifications for such work shall be so prepared as to permit of fair and open competition in paving material as well as in price. In addition to the provision of existing law requiring contractors to keep new pavements in repair for a period of one year from the date of the completion of the work, the Commissioners of the Dis- trict of Columbia shall further require that where repairs are neces- sary during the four years following the said one-year period, due to inferior work or defective materials, such repairs shall be made at the expense of the contractor, and the bond furnished by the con- tractor shall be liable for such expense. 1037 Contracts for com- pletion.
