2546 PROCLAMATIONS, 1932. ~rotect American labor, and for other purposes," the United States Tariff Commission has investigated the differences in costs of produc.. tion of, and all other facts and conditions enumerated in said section with r~pect to, optical instruments of 8. class or type used by the Army, Navy, or Air Force for fire control, frames and mountings therefor, and parts of any of the foregoing, being wholly or in part the growth or product of the United States and of p.nd with respect to like or similar articles wholly or in part the growth or product of the principal competing country; WHEREAS in the course of said investigation a hearing was held, of which reasonable public notice was given, and at which parties inter- ested were given reasonable opportunity to be present, to produce evidence, and to be heard; WHEREAS the commission has reported to the President the results of said investigation and its findings with respect to such differences in costs of production; WHEREAS the commission has found it shown by said investigation that the principal competing country is Germany; that the duty Yol. 46, p. 607. expressly fixed in paragraph 228 (a) of said act, on prism-binoculars, having a magnification greater than five diameters, and valued at more than $12 each, frames and mount~ therefor, 8.nd parts of any of the foregoing, does not equalize the difference in the costs of pro- duction of the domestic articles and the like or similar foreign articles when produced in said principal competing country; and that said difference can not be equalized by proceeding under the provisions of subdivision (a) of said section wd act; WHEREAS the commission has specified in its report the ad valorem rate of duty based upon the American sellinf price as defined in Vol. 46. p. 710. section 402 (g) of said act of the domestic artic es found by the com- mission to be shown by said investigation to be necessary to equalize such difference; and WHEREAS in the judgment of the President such ad valorem rate of duty based upon saId American selling price is shown by such investi- gatIOn of the Tariff Commission to be necessary to equalize such dif- ference in costs of production; Increasing duty to NIH H P'dtfthU'td equalize di 4 erence in OW, THEREFORE, , ERBERT OOVER, resl en 0 e rue costs of production. States of America, do hereby approve said report and proclaim that the rate of duty shown by said difference in costs of production to be necessary to equalize such difference, within the limit provided in said section 336, on prism-binoculars, having a magnification greater than five diameters, and valued at more than $12 each, frames and mountings therefor, and parts of any of the foregoing, is 60 per centum ad valorem based upon the American selling price as defined in said section 402 (g) of said act of prism-binoculars, having a magnification greater than five diameters, frames and mountings therefor, and parts of any of the foregoing, manufactured or produced in the United States.
