F°b“'*“Y 25· ml- CHAP. 475.-An Act To authorize the Mobile and West Alabama Railroad Company to construct and maintain a bridge across the Warrior River, between the counties of Vgagker and Jefferson, in section thirty-tive, township seventeen, range SBVGX1 WGS , ' _ Be it enacted ly the Senate and House of Reiinresentattves of the United ,bl§§,°,Z_"§‘,},{}‘,l0;Vd°°{,,‘l,1,Z States o_fAmewZoa in Congress assembled, That the Mobile and West grgse W°·F¤°*` B*"°'· Alabama Railroad Company, a corporation created and existing under .an act of the general assembly o the State of Alabama, be, and is hereby, authopized to construct and maintain a railroad bridge for the passage of rai way engines and cars across the Warrior River, at such point as may be selected by such company, in section thirty-Eve, township seventeen, range seven west, and approved by the Secretary of D¤*w·<·>*·¤· War, between the counties of Walker and J eiferson, Alabama, said ‘ bridge to be so constructed as not to·obstruct the nawtion of said I1:;:g¤u·;¤·structure river, and to be provided with a suitable draw: Prov' d, That any me post mms. _ bridge constructed under this Act and according to its limitations shall be a lawful. structure and shall be known and recognized as a post route, upon which, also, no higher charge shall be ma e for the trans- . portationover the same of the mail, the troo s, and munitions of war of the United States than the ratgager mills; paid for transportation over railroads or public highways l ing to the said brid e.; and the same is hereby declared to be a post route, and the United States shall wiiéghw °* ’°“'°°**¤ have the right of way for a (postal telegraph across said bridge: Pro- _vided, also, That all railroa cotgpanies desiring the use of said bridge shall have and be entitled to eq rights and privileges relative to the passage of railway trains or cars over the same, and over the approaches thereto, upon gayment of a reasonable compensation for suc use; and in case of any `sagreement between the parties in regardto the terms of such use or the sums to be paid, all matters at issue shall be determhjaed lgdthe gecretary of War upon hearing the allegations and proofs su mit to im. . ‘ Secretugcf WM w. That the bridge authorized to be constructed under this Act °pp'°v° P °°‘ shall be located and built under and subject to such regulations for the securitieof the navigation of said river as the Secretary of War shall rescri ; and the said company or corporation shall submit to the Secretary of War, for his examination and approval, a design and drawing of the proposed bridge and a map of the location, giving, for ‘ the space of one·ha f mile above and one- alf mile below the proposed location, the topography of the banks of the river, the shore lines at highand low water, the direction and strength of the currents, and the souudings, accurately showing the bed of the stream, and shall · furnish such other information as may be required for a full and satisfactory understanding of the subject; and until the said plan and . location of the bridge are approved by the Secretary of War no work
