ORDER IN COUNCIL extending the duration of the Saint Lucia Legislative Council.—London, February 22, 1940([1])
At the Court at Buckingham Palace,
the 22nd day of February, 1940
PRESENT: THE KING’S MOST EXCELLENT MAJESTY IN COUNCIL
WHEREAS it is provided by section 51 of “ The Saint Lucia Legislative Council) Order in Council, 1936,”([2]) that the Governor of the Windward Islands shall dissolve the Legislative Council of Saint Lucia (hereinafter referred to as “the Council”) at the expiration of 3 years from the date of the return of the first writs at the last preceding general election, of it shall not have been sooner dissolved:
And whereas by the said Order power was reserved to His Majesty to revoke, alter, or amend the said Order as to him should seem fit:
Now, therefore, His Majesty by virtue and in exercise of all the powers enabling him in that behalf, is pleased by and with the advice of his Privy Council to order, and it is hereby ordered, as follows:
1. This Order may be cited as “ The Saint Lucia (Legislative Council—Extension of Duration) Order in Council, 1940.”
2. Section 51 of “ The Saint Lucia (Legislative Council) Order in Council, 1936,” shall have no effect from the date of this Order until the Council last appointed and elected before that date shall have been dissolved by virtue of the power contained in section 50 of the said Order and a fresh Council shall have been appointed and elected.
3. His Majesty reserves to himself, his heirs and successors, full power and authority with the advice of his or their Privy Council from time to time to revoke, alter, or amend this Order as to him or them shall seem fit.
