Chapter VI
262. A referendum in municipal matters may be instituted by law, by an absolute majority of the votes of the total number of members of each Chamber.
263. 15 per cent. of the persons registered and residing in a locality shall have the right of proposing measures to the respective council, in matters coming within its jurisdiction. The local council shall consider such proposals, and refer them to the competent authorities.
264. The police shall lend their aid to the mayor and the councils when they require it for the fulfilment of their functions.
Chapter VII
265. In each department there shall be a chief of police appointed by the Executive Power.
266. To be a chief of police it is necessary to have attained 30 years of age; to enjoy the exercise of citizenship, and to be born in the department or to have resided therein for at least 2 years previously.
267. The police shall take their orders directly from the Executive Power.
Section XVII.—Claims against the Administration
Chapter I
268. A tribunal dealing with claims against the administration, composed of three members, shall be established by law.
269. The qualifications for members of this tribunal shall be those established for members of the Supreme Court of Justice, and their appointment shall be made in accordance with the provisions of sub-paragraph (18) of article 75.
The remuneration of these posts and their duration shall be determined by law.
Chapter II
270. The tribunal shall deal with claims against illegal decisions of the administration, adopted by the latter in the exercise of its functions, either in respect of private individuals and bodies, or of public servants.
The acts of municipal authorities and of decentralised services and autonomous bodies shall come within the jurisdiction of the tribunal.
